Beyonce And Jay-Z's Blue Ivy Trademark: An Expert Explains

Couple likely 'trying to protect what they rightfully own or created,' family law expert tells MTV News.

<P><a href="/music/artist/knowles_beyonce/artist.jhtml">Beyoncé</a> and <a href="/music/artist/jay_z/artist.jhtml">Jay-Z</a> have filed an application with the U.S. Patent and Trademark Office to protect their month-old baby's name and reserve it for future use, MTV News has confirmed. The superstar couple reportedly sought the trademark to stop the use of Blue Ivy's name by others. </P><P> </P><P></p><div class="player-placeholder right" title="A Gift Buying Guide For Blue Ivy Carter" id="vid:725377.id:1676907" width="240" height="211"></div><p> </P><P> </P><P>It's a smart move, according to family law attorney and author <a href="http://www.vikkiziegler.com/" target="_blank">Vikki Ziegler</a>. "[Seeking the trademark] forestalls competitors from using the child's name and or third parties from attempting to sell the baby's name back to the couple," Ziegler told MTV News. "They are likely trying to protect what they rightfully own or created, shall we say, by trademarking Blue Ivy's name." </P><P> </P><P>The application to trademark Blue Ivy Carter's name, filed by BGK Trademark Holdings (Beyonc&#233;'s company) is currently pending but will likely be approved because, as the <a href="http://www.washingtonpost.com/blogs/reliable-source/post/blue-ivy-the-trademark-feds-move-fast-on-rights-to-beyonce-and-jay-zs-babys-name/2012/02/03/gIQAOTDGnQ_blog.html" target="_blank"><i>Washington Post</i></a> reports, parents are legally authorized to trademark the names of their minor children. </P><P> </P><P>"In essence, it's a trademark for a brand, and this brand is expected to be one hot commodity &#8212; just look at Blue Ivy's parents," Ziegler said. "Anyone else that tried to use the name after the trademark was approved could be sued and held liable for damages." </P><P> </P><P></p><div class="player-placeholder right" title="Beyonce Will Emerge As A Hollywood Celebrity Mother Brand" id="vid:724613.id:1676907" width="240" height="211"></div><p> </P><P> </P><P>While the Patent Office looks fondly on attempts to trademark the name of one's own child, attempts to do the same with the names of other people's kids are another story, as two designers learned when they sought &#8212; just days after Blue Ivy's birth &#8212; to trademark the baby's name for their own use. </P><P> </P><P>Applications from fashion designer Joseph Mbeh to patent "Blue Ivy Carter NYC" and by an unnamed designer to trademark "Blue Ivy Carter Glory IV" for a fragrance line were denied by the Patent Office, which noted in its decision that the name belonged to a "very famous infant" and consumers would wrongly assume that any products bearing the name had been approved by Beyonc&#233; and Jay-Z. </P><P> </P><P>Ziegler noted that the trademark would "protect against others using the child's name as a brand of merchandise in the same marketplace," so it will not impact the "Blue Ivy" trademark held by a clothing boutique in Sturgeon Bay, Wisconsin. The store filed to trademark <i>its</i> name on January 19, 2011, a year before Queen B and Jay made the name famous. She recalled meeting the singer for the first time 15 years ago, just as she was breaking into the industry herself. </P><P> </P><P></p><div class="player-placeholder right" title="Whitney Houston: Life And Music Of An Icon" id="id:1679030" width="240" height="211"></div><p> </P><P> </P><P>"The loss of Whitney Houston is painful. I remember meeting Whitney for the first time when I was 15. She was the ultimate legend. The ultimate woman. Not only was she confident, poised, stunningly beautiful and intelligent, but she was sincere and kind," she said in a statement to MTV News. "She took the time to make everyone feel like they were very important to her." </P><P> </P><P>Beyonc&#233; continued in the statement that Houston's killer vocal abilities helped make her the superstar she was. "I, like every singer, always wanted to be just like her. Her voice was perfect. Strong but soothing. Soulful and classic. Her vibrato, her cadence, her control. So many of my life's memories are attached to a Whitney Houston song," she said. "She is our queen and she opened doors and provided a blueprint for all of us. God bless her." </P><P> </P><P>Her statement comes on the same day that Houston will be remembered at the 2012 Grammy Awards. B's "Dreamgirls" co-star Jennifer Hudson will lead the <a href="/news/articles/1679040/whitney-houston-grammy-tribute.jhtml"> Grammy tribute to the late icon</a>, along with Houston's longtime friend and collaborator, Chaka Khan. </P><P> </P><P>She joins a long list of divas who have recalled Houston's undeniable influence on their own careers, including Rihanna, Nicki Minaj and Christina Aguilera. </P><P> </P><P>"Heartbroken and in tears over the shocking death of my friend, the incomparable Ms. Whitney Houston," Mariah Carey wrote about the <a href="/news/articles/1679049/whitney-houston-dies-details.jhtml">loss of Houston</a>, who was found dead in her Los Angeles hotel on Saturday."My heartfelt condolences to Whitney's family and to all her millions of fans throughout the world. Whitney Houston dies at 48

It?s no secret she?s had a rough go of it in recent years, and Whitney Houston has died of undisclosed causes, says her publicist Kristen Foster. With her fans and friends understandably devastated by the news, details available thus far tell that the "I Will Always Love You" singer was found unresponsive in her room at the Beverly Hilton hotel on Saturday (February 11). With paramedica arriving within minutes, Houston was pronounced dead at 3:55PM with a full investigation already underway - though there are said to be no signs of foul play. According to TMZ, a search of the Beverly Hilton Hotel room in which the 48-year-old was staying found no illegal drugs, though prescription medications were located. TMZ adds that there's a chance Miss Houston died from drowning in the bathtub, but since her body was removed from the water before EMTs arrived the conclusive determination must await an autopsy. Beyonce Looks 'Sexy' Post-Baby, Destiny's Child Vets Say

Decked out one night in a <a href="/news/articles/1678726/beyonce-post-baby-appearance-blue-ivy.jhtml">body-hugging red number</a> and another in a <a href="http://rapfix.mtv.com/2012/02/08/beyonce-photos-carnegie-hall-night-two ">glittering black cocktail dress</a>, B was out in full force to support her hubby <a href="http://www.mtv.com/music/artist/jay_z/artist.jhtml">Jay-Z</a> when he took the stage for a two-night engagement at New York's famed <a href="/news/articles/1678669/jay-z-carnegie-hall.jhtml">Carnegie Hall</a>. </P><P> </P><P></p><div class="player-placeholder right" title="Former Destiny's Child Members Say Beyonce Looks 'Amazing' Post-Baby" id="vid:732758" width="240" height="211"></div><p> </P><P> </P><P>B certainly left her fans speechless with her ability to bounce back to hotness just a month after giving birth to baby Blue Ivy, and her former Destiny's Child pals were equally floored. Michelle Williams dished to MTV News, "Man, "She looks fantastic, amazing, amazing, amazing. I wasn't surprised because even before she was pregnant she had a six pack, she was very toned. So, obviously it just went back very quickly." </P><P> </P><P>Fellow DC gal pal Kelly Rowland also can't handle how Beyonc&#233; is bringing sexy back one hot dress at a time. "She looks fantastic. <P>Simon Cowell is finally opening up about the cast shakeups on "The X Factor" as well as about rumors that two <i>very</i> famous divas are in talks to join Fox's reality singing competition. </P><P> </P><P></p><div class="player-placeholder right" title="Simon Cowell Compares The British And U.S. Versions Of 'X Factor'" id="vid:698604.id:1672066" width="240" height="211"></div><p> </P><P> </P><P>Late last month, it was announced that judges Paula Abdul and Nicole Scherzinger and host Steve Jones had been <a href="/news/articles/1678191/paula-abdul-exits-x-factor.jhtml"><P>id="1678191">fired from "X Factor"</a> and would be replaced in its second season. The announcement came as a shock to fans, but Cowell tells <a href="http://www.hollywoodreporter.com/live-feed/simon-cowell-x-factor-firings-voice-287806" target="_blank">"Extra"</a> in an interview airing Wednesday (February 8) that the decision was a long time coming and was ultimately made "at the beginning of the year &#8212; and we were told it had to happen straight away." </P><P> </P><P>While her dismissal came as a surprise, Cowell says Abdul "was very gracious" about it. "She understands it's business," Cowell said of his real-life friend. "It's never personal." </P><P> </P><P>Scherzinger, according to Cowell, was "disappointed" with the producers' decision to replace her. But the former Pussycat Doll insisted in a new <a href="http://www.accesshollywood.com/nicole-scherzinger-talks-x-factor-departure-i-have-no-regrets_article_60184" target="_blank">"Access Hollywood"</a> interview that she "had a wonderful experience on the show." </P><P> </P><P>"What happened? Well, all I know is that I gave 110 percent to that show," she said. "I know everybody's talking about it, they're saying good, bad, they love me or hate me, but the one thing you can't say is that I didn't give it my all." </P><P> </P><P>Cowell also used his time with "Extra" to squash rumors that Beyonc&#233; or Mariah Carey might be joining the "X Factor" team when it returns to Fox later this year. He seemed particularly amused by <a href="http://www.reuters.com/article/2012/02/08/idUS114237084820120208" target="_blank">talk</a> that the show was offering Beyonc&#233; a nine-figure contract to join the judges' table. </P><P> </P><P>"The budget for the show is $100 million. That would never ever happen. </P><P> </P><P>It's absolute nonsense," he told "Extra." "No one is going to pay $100 million for someone. I genuinely haven't had a conversation with her about it. Not at all." </P><P> </P><P>The same can be said for Carey, who Cowell said he likes very much and would be a fine addition to the show but is an impractical choice because of the long hours involved. "I adore her, love her," he said. </P><P>"But you can't expect someone who has just had two kids [and] has a record career to make the kind of commitment we would need on this show." </P><P> </P><P>"X Factor" did not perform as strongly as expected in the ratings last fall, which many feel precipitated the planned revamp, though the ever-cool Cowell is not sweating the competition. In this latest interview, Cowell took on "The Voice," which returned to NBC after the Super Bowl and delivered big ratings, saying the makeup of his judging panel is what sets "X Factor" apart. </P><P> </P><P>"I would ask how many records have they made, how many artists have they discovered?" Cowell asked of "The Voice" mentors Christina Aguilera, Cee Lo Green, Adam Levine and Blake Shelton. "That's where we have to be different on the judging panel. It's very important that you have people on the panel that have actually signed and made artists successful all over the world, not just have made hit records yourself."</p>

Tenacious D Return To Reclaim Title As Rock Ultra-Gods

New video chronicles the duo's return to rockdom and announces their third studio album, Rize of the Fenix.

"Some call them kings. Others call them gods, but one thing that everyone agreed on was that Tenacious D was more talented than the Beatles, Stones and Zeppelin combined."

Those are the immortal words of "Extra"'s Maria Menounos, retelling the tragic story of the greatest rock band to ever rock, Tenacious D. Members Jack Black and Kyle Gass apparently fell on rough times after the box-office failure of their film, "Tenacious D in the Pick of Destiny."

But after years in a mental hospital and "lots of drugs," Tenacious D have returned with a brand-new video and news of their third studio album, Rize of the Fenix.

The new video shares the story of the lost years of Tenacious D. After a nervous breakdown, Gass spent years locked away, only to escape in hopes of reuniting with his former bandmate, Black, now going by the name "Hollywood Jack."

Entitled "To Be the Best," the video chronicles D's climb back to the top of all of rockdom.

In traditional Tenacious D style, the boys have some of their famous friends stop by to join in on the fun. In an interview recalling D's spectacular fall from grace, Academy Award-winning actor Tim Robbins shared his memory of Gass' battle with his demons. "Kyle couldn't take the pressure," he said. "It was no more Kyle. It was only Rage Kage."

The most tragic part of the return of Tenacious D comes at the expense of Val Kilmer's life. The method actor takes a bullet fired by Gass and meant for Black, but his death was not in vain. The incident spurred the Tenacious D reunion fans have been begging for since 2008.

Unfortunately, during their hiatus, both Black and Gass forgot how to rock. Thankfully, Dave Grohl, Josh Groban and two books, "Blowing F---ing Minds for Idiots" and "Impregnating Ears for Idiots," were there to help out.

Rize of the Fenix will be in stores on May 15.

Stevie Ryan may make fun of Justin Bieber on her new VH1 show "Stevie TV," but the actress and the pop star actually have something cool in common: They were both discovered on YouTube.

Ryan began her career impersonating celebrities and creating her own characters on her YouTube channel and instantly became an Internet star. Now the 26-year-old comedian gets to do her routines on VH1, portraying some of today's biggest celebs and reality TV stars.

"It's just a female's perspective on pop culture, really, at least that's the way I think about it," Ryan told MTV News on Tuesday. "It's really just kind of making fun of pop culture, what's happening in it, just making fun of these celebrities that are rewarded for bad behavior."

So far on "Stevie TV," Ryan has created a music video that mocks Katy Perry's "Last Friday Night (T.G.I.F)," gotten into character as Lady Gaga and done some cross-dressing to get into one of her favorite roles, Justin Bieber.

Ryan explained that Bieber has been the most fun to play "because I always tell everybody how guys and girls always like me when I'm Justin Bieber. ... Girls are like, 'You're so cute, like, are you really a girl?' And then guys are like, 'I don't know what it is, but you're really hot.' But I really like playing everybody," she laughed.

And though she may poke fun at celebrities, Ryan said she's really a fan of most of the stars ... except maybe one.

"I just thought, 'What a great way to kind of show that this is what the younger generation is growing up with, that who little girls like, is Kim Kardashian,' " Ryan said. "It's just observing these weird behaviors and finding a place for them that makes sense because you can always make fun of Kim Kardashian — she has a big butt, she made a sex tape — but at the same time you have to step back and look at the big picture; people are actually wanting to be like this."

As for future episodes, Ryan really wants to impersonate a certain Young Money rapper. "I would like to do Nicki Minaj," Ryan revealed. "There's nothing that I want to make fun of about her, because I'm obsessed with her and I really, really love her."

Asked if she's gotten any backlash yet for the sometimes harsh jokes on her show, Ryan said she hasn't, but she's ready if it comes her way.

"It hasn't happened before and I'd give a flying f--- about what any of them have to say," Ryan said. "Because I'm just doing my job just like they are and so whatever, if anyone has anything to say, bring it!"

"Stevie TV" airs Sundays at 11 p.m. ET on VH1.

Her right leg pose was one of the major topics of conversation arising from the 84th Annual Academy Awards show, and now Angelina Jolie has finally addressed the issue which has since spawned the term 'jolie-ing'.

Speaking with Huffington Post on her Versace dress right leg exposure , the 36-year-old actress told, "I honestly didn't pay attention to it. You know what I mean?"

Explaining further, Jolie dished, "I don't watch those TV shows and if I go online and see something about myself, I don't click on it. And the people I surround myself with don't really talk about that kind of stuff. [Laughs]."

'Hangover Part III' Due Next Summer

Nothing beats a classic movie trilogy. And while nobody is rushing to compare "The Hangover" to "Star Wars," director/producer Todd Phillips is aiming to end the hugely successful morning-after comedy franchise with a third and final chapter next summer. According to The Hollywood Reporter, Phillips confirmed on Thursday that "The Hangover Part III" will indeed wrap up the series when it's released next summer.

"We're going to surprise a lot of people with the final chapter we have planned," Phillips said. "It will be a fitting conclusion to our three-part opera of mayhem, despair and bad decisions." The movie is slated to hit theaters on May 24, 2013, hoping to capture some of the same box-office magic that the second installment grabbed when it launched on that same weekend in 2011 on its way to a massive $581.5 worldwide gross.

Additional good news came with the confirmation that after extensive negotiations, stars Bradley Cooper, Ed Helms and Zach Galifianakis are all onboard for the third go-round. To date, the first two movies have grossed more than $1 billion worldwide, a rarity for an R-rated comedy franchise. It was such an unexpected smash, in fact, that the Reporter noted that Warner Bros. studio didn't even sign the stars to option deals for sequels because no one expected the original 2009 film to gross more than $467 million. That resulted in the "wolfpack" trio getting "hefty" raises for the second film and a reported $15 million each for the third movie.

Phillips will again work on the script with "Part II" co-writer Craig Mazin, but he would not tip his hand as to where the third movie will take place. The magazine reported that a recent draft of the script indicated that it was set in Los Angeles and that it deviated from the "what happened to us last night?" formula of the first two films.

Cooper recently lent credence to the script speculation
 when he revealed in a December interview, "We adhered to the formula in the second one, for those of you who've seen it, and the third one, which would close the whole sort of trilogy, which now it would be a trilogy — even though we thought we would never make a second one, let alone anybody see the first one — I think it will take place in Los Angeles and maybe not adhere to the structure. It might be different."

'American Idol' Report Card: Jessica Sanchez, Elise Testone Lead The Pack

It was difficult to decide what was the most shocking part of Wednesday night's "American Idol": Erika Van Pelt's new "Little Nicky" hairdo? The fact that Elise Testone may have finally found her way out of the bottom three? Or that, with the full Billy Joel catalog at their disposal, none of the contestants decided to take on "The Stranger" or "I Go to Extremes"?

Nah, we're gonna say it was whatever Heejun Han was attempting to do with his mid-set strip show (just in case you haven't watched yet, boy was this a special episode of "Idol"). Anyway, while we're still scrubbing H.H. from our collective consciousness, we took a minute to hand out some grades for a truly Joel-a-riffic night. Who rode high on the River of Dreams? Who drove their car into a house in the Hamptons? Read on to find out!

Jessica Sanchez: She's the one to beat, and now she seems to know it, as evidenced by her thorough throttling of "Everybody Has a Dream." It was perhaps a bit too literal (like, we get it, this is your dream), but dang, when she lets it rip, there's really no one else who even comes close. Standing ovation, massive praise from the judges, the overwhelming desire to just give her the crown right now ... with Sanchez, it's the same every week, just like our grade for her performance. A

Elise Testone: It only took her three weeks, but Testone finally found her groove, positively killing "Vienna" (wait, that sounds weird). Her full repertoire was on display, and she even worked in some of those goofy hand gestures that all the great divas make when they know they're on point. And she was. She earned a richly deserved standing ovation for her efforts, and if she's in the bottom three again this week, America is officially the worst. A

Erika Van Pelt: Her newly darkened hair only added to her attitude, and there was plenty of it on display during her version of "New York State of Mind." Sultry and soulful, if perhaps a touch too lounge singer for our liking, but still, she was miles above pretty much everyone else on this night ... and for once, people are actually talking about her. Even if it is because of her hair. Small victories, folks. B+

Skylar Laine: She's got a great voice, and the fact that she's still standing in the competition is proof that she's a survivor, but still ... it would be nice to see her step outside her country comfort zone for once. Shoot, she did Garth Brooks' version of "Shameless." Kinda screechy in parts, but a solid ending probably ensures she's safe for another week. The judges didn't do her any favors, though. B-

Hollie Cavanagh: Another week, another big ballad from the pint-size powerhouse. This time it was "Honesty," and yes, as Steven pointed out, it was plenty pitchy. Randy also got in on the act, giving her the dreaded "come on now." Yowch. Perhaps the cracks are starting to show. Also, it would be nice to see her change things up a bit, provided she's still here next week, of course. C+

Joshua Ledet: His roller-coaster ride through "Idol" (The highs! The lows! The Mantasia!) bottomed out this week, as he struggled to connect with "She's Got a Way." Still, he battled through, hit some nice notes (and some not-so-nice ones, too), but we have a creeping suspicion the Josh-a-coaster might be entering its final turn, which is a shame, considering all he's capable of. Like the suddenly sage-like Randy said, "Never ever feel defeated!" C

Deandre Brackensick: He kicked off the show with an even — if forgettable — version of "Only the Good Die Young," and after three weeks of live performances, "even" and "forgettable" are about par for the course for him. Earned polite praise from the judges, a few screams from the crowd, wore a cool vest thingy, but perhaps this is the week the somewhat-good really do die young. C-

Colton Dixon: Oh, no way, he did "Piano Man"! Shocking. Also, lyrical content aside, isn't this song supposed to be fun? Not in Colton's world, apparently. Gave J.Lo goosies, probably because she was sitting on an air conditioner or something. The girls in the audience liked it, too, so once again he'll be safe, but c'mon man, lighten up a bit. And change your hair. It's not 2003 and Warped Tour doesn't kick off for a few more months. C-

Phillip Phillips: Totally "Phillip Phillps'd" (thanks Steven!) "Movin' Out," which basically means he slowed the thing down to a dirge and growled a bunch. Congrats, dude, you proved it's possible to suck the life out of even the most jovial of tunes! Randy, who was apparently watching a different show or something, called it "one of the best renditions of the song ever." Go buy a house out in Hackensack, dawg. D

Heejun Han: He mystified both Diddy and Tommy Hilfiger, which hasn't happened since Nelly decided to get into the clothing game, then went out and mystified everyone watching "Idol" with his goofy version of "My Life." Apparently it was supposed to be funny or something. Gee, it's a good thing the judges decided to keep him and not, you know, someone who actually wanted to win this thing. Note to Heejun: You're not as clever as you think. F-

Randy also got in on the act, giving her the dreaded "come on now." Yowch. Perhaps the cracks are starting to show. Also, it would be nice to see her change things up a bit, provided she's still here next week, of course. C+

Joshua Ledet: His roller-coaster ride through "Idol" (The highs! The lows! The Mantasia!) bottomed out this week, as he struggled to connect with "She's Got a Way." Still, he battled through, hit some nice notes (and some not-so-nice ones, too), but we have a creeping suspicion the Josh-a-coaster might be entering its final turn, which is a shame, considering all he's capable of. Like the suddenly sage-like Randy said, "Never ever feel defeated!" C

Deandre Brackensick: He kicked off the show with an even — if forgettable — version of "Only the Good Die Young," and after three weeks of live performances, "even" and "forgettable" are about par for the course for him. Earned polite praise from the judges, a few screams from the crowd, wore a cool vest thingy, but perhaps this is the week the somewhat-good really do die young. C-

Colton Dixon: Oh, no way, he did "Piano Man"! Shocking. Also, lyrical content aside, isn't this song supposed to be fun? Not in Colton's world, apparently. Gave J.Lo goosies, probably because she was sitting on an air conditioner or something. The girls in the audience liked it, too, so once again he'll be safe, but c'mon man, lighten up a bit. And change your hair. It's not 2003 and Warped Tour doesn't kick off for a few more months. C-

Phillip Phillips: Totally "Phillip Phillps'd" (thanks Steven!) "Movin' Out," which basically means he slowed the thing down to a dirge and growled a bunch. Congrats, dude, you proved it's possible to suck the life out of even the most jovial of tunes! Randy, who was apparently watching a different show or something, called it "one of the best renditions of the song ever." Go buy a house out in Hackensack, dawg. D

Heejun Han: He mystified both Diddy and Tommy Hilfiger, which hasn't happened since Nelly decided to get into the clothing game, then went out and mystified everyone watching "Idol" with his goofy version of "My Life." Apparently it was supposed to be funny or something. Gee, it's a good thing the judges decided to keep him and not, you know, someone who actually wanted to win this thing. Note to Heejun: You're not as clever as you think. F-
